PAYMENT SCHEDULE: 50% of the Total Rent is due at time of booking. The Remaining Balance is due 1 day after arrival if paid in cash, or 1 week prior to arrival if paid by credit card, Zelle, or bank transfer.
CANCELLATION POLICY: 90% of the Rental Deposit is refundable when canceled 180 days before arrival or earlier. The Rental Deposit is non-refundable if cancelled with less than 180 days’ notice.
DAMAGE PROTECTION: On the arrival day, a pre-authorization of $750 USD is placed on the credit card used for booking. It will be voided on the day after departure provided that no damages were incurred
CHECK-IN / CHECK-OUT: Check-in is at 3:00 PM. Check out time is 11:00 AM. Early check-in and late check-out are not available unless confirmed in writing by the Administrator.
STAFF: Included in the Total Rent are our houseman and cleaning services. Our houseman offers bartending and general concierge services, and works 40 hours per week (8 hours a day, 5 days a week). Cleaning services of the common areas, as well as cleaning services in each room, are available at no additional charge daily between 9am and 3pm. Private Chef Services are available for hire but are not included in the Total Rent.
REGISTERED GUESTS: Up to 24 Overnight Guests are included in this reservation. If the number of Overnight Guests exceeds 24 guests and/or what has been established with the Administrator, each additional person will be charged a published rate of $5000 MXN per night. Additional guests (“Visitors”) may enjoy the Property’s common spaces during the day at an additional charge of $300 MXN per person per day (this is considered a “Visitor Day Pass”). The Renter must solicit Visitor Day Passes from the Administrator in writing with at least one day’s advanced notice. The maximum number of Guests and Visitors allowed on the Property at any given time is 35 people in total. If Visitors are at the Property without the Administration’s expressed consent, there is a penalty fee of $1000 MXN per Visitor.
CLEANING: The Property will be inspected, cleaned, and sanitized prior to the Party’s arrival. Guests are required to leave the Property in the same general condition that they received it. Items from each room should be in their rightful places. Please refer to the property guidebook for a more specific check-out task list.
SMOKING: The only location where smoking is permitted on the Property is in the designated smoking area that is located in the garage. This is strictly enforced. There is a $5000 MXN fee for smoking elsewhere on the premises.
PETS: No animals may be on Property without prior written approval of the Administrator.
EVENTS: Events may be held at the Property with written permission from the Administration.
NOISE: Villa Tayrona is located in a residential neighborhood. Loud music is prohibited after 10pm unless special permission is requested from the Administration. The villa is equipped with a privacy-safe noise monitoring system that notifies both the Administrator and guests if noise limits are being exceeded.
SERVICE PROVIDERS: All Service Providers (e.g. caterers, musicians) working in the villa must be pre-approved by the Administrator. A photo of the Service Provider’s identification and their contact information must be provided to the Administrator prior to their entry.
PERSONAL EFFECTS: Villa Tayrona assumes no responsibility for personal items left behind, forgotten or lost at the Property. Villa Tayrona staff will search for, retrieve and return any missing items as soon as possible after notification, though retrieval and postage fees may apply. Items not claimed after 30 days will be donated.
DUE CARE AND SUPERVISION: The Party acknowledges that the Property’s pool is not fenced in, that it is possible to climb over the railings in the lofts and terrace, and that the marble flooring is slippery when wet. Guests are required to take due care when staying in Villa Tayrona and be especially watchful of children in these areas. Additionally, Guests are responsible for maintaining the Property’s doors locked at all times. Guests must abide by the Property Rules posted inside of each room’s door, as well as the Pool Rules posted near the pool.
ENTRY AND DISCLOSURE: Villa Tayrona’s appointed staff shall have the right to enter the Property at any given time. Properties are monitored for noise and via video as permitted by law.
HOLD HARMLESS: Villa Tayrona does not assume any liability for loss, damage or injury to members of the Party or their personal property, regardless how such losses may occur, nor does it accept liability of any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, or plumbing. The Party agrees to hold Villa Tayrona harmless from any such claims.
FORCE MAJEURE: Villa Tayrona does not accept liability for any loss or damage caused by Force Majeure, including weather conditions, airport closures, natural disaster, pandemics, war, acts of God, or any other event beyond our control. Villa Tayrona recommends guests purchase private trip cancellation insurance for coverage in case of such circumstances.
JURISDICTION AND VENUE: The parties hereby state that in this Agreement there is no bad faith, error, fraud, deceit or any other defect in consent that might void the Agreement and they hereby agree to submit to applicable law and competing tribunals of Bahía de Banderas, Nayarit, Mexico, expressly waiving any other jurisdiction that may correspond to them regarding their current or future addresses or regarding any other reason whatsoever.
